Terms of Service

HOLODATA offers two kinds of services: (a) Cyber-divination / fortune-telling tools — combining the traditional algorithms of the Eight Schools (BaZi, Ziwei Dou Shu, Zhou Yi, Liu Yao, Mei Hua, Tarot, Qimen Dunjia, Da Liuren) with our HOLOS reasoning engine (a Large-Language-Model-based text generation system) to produce interpretive readings; (b) AI consulting and AI Skills demonstrations — privately-deployed AI infrastructure and bespoke productivity tooling for enterprises.

All readings, chart interpretations, and AI outputs are the result of computation and text generation. They are by their nature entertainment, cultural, and reflective content, and do not constitute a guarantee of future events, a deterministic prediction, medical advice, psychotherapy, legal counsel, financial or investment advice, decisions about marriage, children, or any other significant life decision.

You must be at least 18 years old (or the local age of majority, whichever is higher) and have full legal capacity to enter into a binding contract. If you are under 18, do not use the Service. We reserve the right to verify age.

You must use the Service in your individual capacity unless you have entered into a separate written agreement with us authorising organisational use.

When registering, you must provide a real, accurate, and complete email and name (or a reasonable handle). You are responsible for safeguarding your password; we are not liable for losses arising from your failure to do so.

A natural person may register only one account. You may not lend, transfer, sell, or share your account. We may verify account information at any time and may suspend or terminate accounts engaged in impersonation, abuse, or bulk automated registration.

The inputs you provide while using the Service (name, birth moment, birth location, question text, uploaded content, etc.) and the readings, charts, hexagrams, and records produced by the engine from those inputs (collectively, "User Content") belong to you.

To operate the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to store, cache, display, transmit, back up, and compute on this content solely for the purpose of running the Service. We will not publish your User Content on the public internet unless you explicitly enable the "share" feature.

You may not submit: the personally-identifying details of another person without their consent; the birth information of a minor (even your own child); content that is unlawful (violence, pornography, contraband, defamation, child exploitation); content describing another person's medical condition in a way that identifies them; trade secrets; or other confidential information. We may remove such content and terminate your account immediately.

You agree not to:

• reverse-engineer, decompile, scrape, mirror, or bulk-download the Service or its outputs;
• circumvent the anonymous rate limits (currently three free casts per day) using automation, bots, or proxies;
• attack the Service via DoS, injection, XSS, credential-stuffing, or similar means;
• use our reasoning engine, prompts, or chart datasets to train other AI models;
• impersonate HOLODATA or other users, or forge our email or branding;
• use the Service for money laundering, fraud, multi-level-marketing, religious indoctrination of vulnerable persons, or any illegal activity;
• attach misleading "medical diagnosis", "legal advice", or "investment advice" labels to outputs and resell them to third parties.

All divination, fortune-telling, casting, and AI outputs on this Service are entertainment and cultural-exploration content. They do NOT constitute scientific prediction, medical diagnosis, legal counsel, financial or investment advice, or guidance for any major life decision.You bear sole responsibility for any consequences (including but not limited to financial loss, harm to health, relationship breakdown, opportunity cost, or emotional distress) that result from believing, relying on, citing, or circulating the Service's outputs. If you are experiencing psychological distress, a medical emergency, or financial crisis, please seek help from a licensed doctor, registered counsellor, qualified lawyer, or licensed financial adviser — not this Service.

We make no warranty as to the "accuracy", "efficacy", or "authority" of any reading. The HOLOS reasoning engine is a large-language-model text-generation system; it may produce factual errors, mis-quote classics, or misinterpret structural facts despite our best efforts at citation verification, terminology validation, and traceability. None of these efforts constitute any warranty.

All content of the Service — including but not limited to the HOLODATA brand, the HOLOS engine name, the UI design, visual assets (school sigils, tarot cards, hexagram seals, the Lo Shu grid, the heaven-earth board diagrams and every SVG and image), prompts and system instructions, source code, database schema, documentation, and copy — is the property of HOLODATA or its lawful licensors and is protected by copyright, trademark, patent, and other applicable laws.

You may not copy, modify, distribute, adapt, sublicense, sell, or otherwise commercially exploit any of the foregoing without our prior written permission. All rights not expressly granted in this Agreement are reserved to HOLODATA.

The Service relies on the following third-party providers: Cloudflare (CDN, Workers, D1 database, DNS); Resend (transactional email); Better-Auth (account system); upstream large-language-model APIs (powering the HOLOS engine). Each has its own terms and privacy practices. Our availability depends in part on theirs.

The Service may link to third-party sites (e.g. classical-text references on /learn). Their content, operation, and privacy practices are independent of us and we accept no responsibility for them.

How we collect, use, store, and protect your personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference.

To the maximum extent permitted by applicable law, HOLODATA and its officers, employees, partners, and affiliates shall not be liable to you or any third party for any indirect, incidental, special, punitive, consequential, or exemplary damages (including but not limited to lost profits, lost goodwill, lost data, lost opportunity, or emotional distress) arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

In any event, our total aggregate liability to you (whether in contract, tort, warranty, or any other theory) shall not exceed the amount you actually paid us in the 12 months prior to the event giving rise to the claim (if any), or AUD 100, whichever is lower.

You agree to indemnify and hold harmless HOLODATA and its affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your breach of this Agreement; (b) your violation of any law or third-party right; (c) the User Content you submit; (d) your abuse of the Service; (e) any consequence arising from using outputs of the Service for purposes prohibited by this Agreement (medical, legal, financial decisions, etc.).

The Service is provided on an "as-is" and "as-available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of security vulnerabilities. We reserve the right to: modify, suspend, or terminate any part of the Service at any time; adjust anonymous free-tier limits (currently three per day); adjust paid plans (if launched in the future); unilaterally terminate accounts that violate this Agreement.

You may delete your account and all User Content at any time via account settings. After deletion we will remove the data from the live Service within a reasonable period (typically 30 days), though backups and records required for compliance (fraud prevention, response to legal process) may be retained for a reasonable additional period.

We may modify this Agreement at any time. Updated versions will be posted on this page, and material changes will be notified to registered users by email or in-product notice. Continued use of the Service constitutes acceptance of the modified Agreement. If you do not accept, your sole remedy is to stop using the Service and delete your account.

This Agreement is governed by the laws of the Commonwealth of Australia and the State of New South Wales, without regard to conflict-of-laws rules.

Any dispute arising out of this Agreement or use of the Service shall first be addressed by good-faith negotiation through info@holodata.au. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of competent courts in Sydney, Australia. To the extent permitted by law, you waive any right to bring or participate in any class-action or representative proceeding.

This Agreement, the Privacy Policy, and any supplemental terms we enter into with you in respect of specific services together constitute the entire agreement between you and HOLODATA, superseding any prior oral or written communication.

If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right under this Agreement shall not be deemed a waiver of that or any future right.
